1. Scope of Application

These General Terms and Conditions ("GTC") apply to all contracts for the sale, preparation, delivery, and collection of food, beverages, and related products ("Goods") between Stern Kebab & Pizza Enzweihingen ("we", "us", "our") and the customer ("you") via our website, mobile application, telephone, or other ordering channels.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB). An entrepreneur is a natural or legal person acting in the exercise of their trade, business, or profession (§ 14 BGB).
Any conflicting or deviating terms of the customer shall not apply unless expressly agreed by us in writing.

2. Conclusion of Contract

The presentation of products on our website, menus, advertising materials, or ordering platforms does not constitute a legally binding offer.
By placing an order, you submit a binding offer to purchase the selected Goods.
The contract is concluded when we accept your order by:
- sending an order confirmation by email, SMS, or other electronic means; or
- commencing preparation of the ordered Goods.
We reserve the right to reject orders at our discretion, particularly if the delivery address lies outside our delivery area or if the order cannot reasonably be fulfilled.

3. Freshly Prepared Food and Order Cancellation

All food items offered by us are freshly prepared specifically for each customer after an order has been placed.
Customers may request cancellation of an order only before food preparation has started.
Once our kitchen team has begun preparing the order, cancellation is no longer possible and the full purchase price remains payable.
If you wish to request cancellation or modification of an order, please contact us immediately by telephone at:

+49 7042 9113883

Submission of a cancellation request does not automatically result in cancellation. Cancellation is effective only if expressly confirmed by us and only if preparation has not yet commenced.

4. Prices and Payment

All prices shown include applicable statutory German VAT.
Delivery fees, where applicable, are displayed separately before completion of the order.
Available payment methods are displayed during checkout and may include:
- Cash on Delivery
- Cash on Pickup
- Debit/Credit Card
- PayPal
- Other payment methods offered during checkout
Payment becomes due immediately upon conclusion of the contract unless otherwise agreed.
Ownership of the Goods remains with us until full payment has been received.

5. Delivery and Pickup

Delivery

Delivery is available only within our designated delivery area.
Estimated delivery times are provided for guidance only and are not guaranteed unless expressly agreed otherwise.
Delivery times may be affected by traffic conditions, weather, operational requirements, high order volumes, force majeure events, or other circumstances beyond our reasonable control.

Pickup

Customers selecting pickup will be informed when their order is ready for collection.
Orders should be collected promptly after notification.
If an order is not collected within a reasonable period after preparation, we reserve the right to dispose of the food without refund, as food quality and safety can no longer be guaranteed.

6. Right of Withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.
However, pursuant to § 312g para. 2 no. 2 BGB, the right of withdrawal does not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly.
Our products consist primarily of freshly prepared meals, including pizzas, kebabs, salads, and similar food items, which are produced specifically for each order and are perishable.
Therefore, no statutory right of withdrawal exists once the order has been accepted and preparation has commenced.

7. Warranty and Complaints

Statutory warranty rights remain unaffected.
Customers should inspect their order immediately upon receipt.
Any obvious defects, missing items, or incorrect deliveries should be reported without undue delay by contacting us at:

Email: ullah.abdpk@gmail.com
Phone: +49 7042 9113883
We will review complaints fairly and, where appropriate, provide replacement products, refunds, or other suitable remedies.

8. Liability

We are fully liable for damages caused by intent or gross negligence.
In cases of ordinary negligence, our liability is limited to breaches of essential contractual obligations and to foreseeable damages typical for such contracts.
Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
Nothing in these GTC excludes liability for injury to life, body, or health where such exclusion would be unlawful.

9. Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform:

https://ec.europa.eu/consumers/odr/

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Amendments to these Terms

We reserve the right to amend these GTC where necessary for legal, technical, or operational reasons.
The current version will always be available through our website or ordering channels.

11. Severability Clause

Should any provision of these GTC be invalid or unenforceable, the remaining provisions shall remain unaffected and continue in full force and effect.

12. Applicable Law and Jurisdiction

These GTC shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection provisions of the country in which a consumer has their habitual residence remain unaffected.
If the customer is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction shall be Vaihingen an der Enz, Germany.
