1. Scope of Application

These General Terms and Conditions ("GTC") apply to all contracts for the sale, preparation, delivery, and collection of food, beverages, and related products ("Goods") between Stern Kebab & Pizza Enzweihingen ("we", "us", "our") and the customer ("you") via our website, mobile application, telephone, or other ordering channels.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB). An entrepreneur is a natural or legal person acting in the exercise of their trade, business, or profession (§ 14 BGB).
Any conflicting or deviating terms of the customer shall not apply unless expressly agreed by us in writing.

2. Conclusion of Contract

The presentation of products on our website, menus, advertising materials, or ordering platforms does not constitute a legally binding offer.
By placing an order, you submit a binding offer to purchase the selected Goods.
The contract is concluded when we accept your order by:
- sending an order confirmation by email, SMS, or other electronic means; or
- commencing preparation of the ordered Goods.
We reserve the right to reject orders at our discretion, particularly if the delivery address lies outside our delivery area or if the order cannot reasonably be fulfilled.

3. Freshly Prepared Food and Order Cancellation

All food items offered by us are freshly prepared specifically for each customer after an order has been placed.
Customers may request cancellation of an order only before food preparation has started.
Once our kitchen team has begun preparing the order, cancellation is no longer possible and the full purchase price remains payable.

4. Prices and Payment

Available payment methods are displayed during checkout and may include:

Payment becomes due immediately upon conclusion of the contract unless otherwise agreed.

Delivery is available only within our designated delivery area.
Estimated delivery times are provided for guidance only and are not guaranteed unless expressly agreed otherwise.
Delivery times may be affected by traffic conditions, weather, operational requirements, high order volumes, force majeure events, or other circumstances beyond our reasonable control.

Pickup

Customers selecting pickup will be informed when their order is ready for collection.
Orders should be collected promptly after notification.
If an order is not collected within a reasonable period after preparation, we reserve the right to dispose of the food without refund, as food quality and safety can no longer be guaranteed.

6. Right of Withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.
However, pursuant to § 312g para. 2 no. 2 BGB, the right of withdrawal does not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly.
Our products consist primarily of freshly prepared meals, including pizzas, kebabs, salads, and similar food items, which are produced specifically for each order and are perishable.
Therefore, no statutory right of withdrawal exists once the order has been accepted and preparation has commenced.

7. Warranty and Complaints

Statutory warranty rights remain unaffected.
Customers should inspect their order immediately upon receipt.

12. Applicable Law and Jurisdiction

These GTC shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection provisions of the country in which a consumer has their habitual residence remain unaffected.
